New York employers have clear legal obligations when it comes to sexual harassment prevention training. Both New York State and New York City require annual, interactive training for all employees.

The goal is simple: build workplaces where respect is the rule and everyone understands their rights and responsibilities. Moreover, training helps reduce employers’ risks as we’ve discussed before.

What the State Law Requires

Every New York employer, regardless of size, must ensure that all employees complete annual, interactive training.

Interactive means that employees can ask questions and get answers, not just click through a slide deck.

The required topics include:

  1. What sexual harassment is under State and federal law
  2. Examples of conduct that’s illegal
  3. How to report harassment internally
  4. How complaints are handled and investigated
  5. A reminder that retaliation is strictly prohibited

Employers also must provide a written harassment prevention policy and distribute complaint procedures to every employee.

Extra Rules for New York City Employers

In New York City, municipal law adds further requirements. Employers with 15 or more employees must train everyone, and that means employees, interns, and certain independent contractors each year. They also must keep signed acknowledgments and training records for at least three years.
