Effective February 24, 2019, the Gender Expression Non-Discrimination Act became law in New York. It protects individuals from harassment or discrimination based on their gender identity or expression.
For New York employers, this means they cannot ever discriminate based on gender identity and expression, including on the basis of an individual’s transgender status. Practically speaking, this shouldn’t come as a surprise to employers because New York courts long have concluded that the Human Rights Law prohibits this discrimination.
