  • BREAKING: NYS Proposed Guidance on Mandatory Sexual Harassment Training & Policies

On August 24, 2018, New York State released proposed requirements for sexual harassment policies and annual trainings that are mandatory for New York employers beginning October 9, 2018.

While most of the proposed requirements were expected, a few important points stand out:

  • First, as of right now, the State expects your employees to be fully trained by January 1, 2019.

  • Your anti-sexual harassment policy must include a complaint form.

  • The policy must be provided to employees in the language that they speak.

  • All employees (even temporary, seasonal, transient and part-time) must be trained every year.

  • Employers may offer annual training based on calendar year, anniversary date, or any other date the employer chooses.

  • All new hires must be trained within 30 days of hire.

  • Employers must ensure every employee is trained. Simply offering the annual training isn’t enough.

While these requirements aren’t final yet and are subject to public comment through September 12th, they provide the most up-to-date insight on what the State will require in the immediate future.
