New York employers have been impacted by big changes to the New York State Election Law. You can read about those changes here.

The new statute requires employers to give employees up to three hours of paid time off to vote. However, the statute wasn’t entirely clear about whether employers could require them to use up their paid time off, commonly known as “PTO,” to vote.

Recent guidance from the New York State Board of Elections tells us that employers are barred from requiring employees to take PTO in order to vote. While the law itself doesn’t make this clear, these purported FAQs say that requiring an employee to use her PTO would be contrary to the intent of the new law.
